As the City of Irvine continues its efforts to acquire the All American Asphalt facility in Orchard Hills, operations at the asphalt manufacturing facility are still the source of local odor violations.   

Since Dec. 19, All American Asphalt has been issued three different odor violations, with the most recent violation occurring on Jan. 24.

Per its most recent violation, issued by South Coast Air Quality Management District, the description on the Notice of Violation states that the facility was releasing quantities of air contaminants to the point of “considerable nuisance.”

The notice states a violation occurs when, “Discharging such quantities of air contaminants which cause nuisance to a considerable number of persons or to the public.”

AQMD’s Rule 402 states: “A person shall not discharge from any source whatsoever such quantities of air contaminants or other material which cause injury, detriment, nuisance, or annoyance to any considerable number of persons or to the public, or which endanger the comfort, repose, health or safety of any such persons or the public, or which cause, or have a natural tendency to cause, injury or damage to business or property.”

The facility’s two previous violations, issued on Dec. 19 and Dec. 21 last year, were also filed under the 402 Nuisance rule.

Last month, Irvine City Manager Oliver Chi explained that the city had been making notable progress in working to acquire the facility. 

“We previously reported that the city is working to acquire the All American Asphalt plant, in an effort to effectuate the closure of the operation. Over the past few weeks, the city has been redoubling our efforts to actually acquire the AAA site,” he said. “We’re aware there’s a significant amount of public interest in this overall effort – we’re limited at this point on what we can share publicly – we did want to report that significant progress is being made.”

Chi added that the city’s end goal is to acquire the facility, a purchase they hope to make public in the coming weeks.

“Our ultimate end goal is to acquire the AAA site in order to convert that 12 acre piece of property into a public park facility, to serve as a gateway into the northern open space location,” he said. “There’s a lot of moving parts to the effort as we move through the next couple of weeks we will absolutely have more to share.”
