As long as the delta-9 concentration falls within the 0.3 percent limit, it fits the 2018 US Farm Bill’s current wording. Yes, this is a questionable technicality, but some brands feel it’s worth the risk to offer potentially lucrative delta-9 products.

Even after manufacturers explain how hemp-derived delta-9 gummies are “legal,” most customers can’t believe they’re legit—and rightfully so! While hemp delta-9 THC gummies tick all the boxes in the 2018 US Farm Bill, they will face increased legal scrutiny at the local level. Many states have already put restrictions on delta-8 THC, so there’s no reason to believe they wouldn’t target these delta-9 gummies.
Delta-9 gummies are technically legal if they have ≤ 0.3 percent delta-9 and come from hemp plants. However, delta-9 THC remains a Schedule I drug at the federal level. Since both of these laws are somewhat contradictory, it’s hard to say whether delta-9 edibles are “safe” to buy in the USA.
The only customers who could feel confident about trying hemp delta-9 THC edibles are those who live in states with relaxed recreational weed laws. Otherwise, customers should be hesitant about ordering hemp-derived delta-9 goods at this time.
