It’s no secret that cannabis has always been around “underground” on college campuses. Watch any film that chronicles college life from the 1960s onward, and you’ll find plenty of references to pot. However, just because cannabis circulated on many American campuses, that never meant it was legal in dorms. Quite the contrary.
For most of the 20th century, every US state outlawed pot. Even though some territories have lifted their bans on cannabis, THC remains a federally illegal substance. Plus, the Drug-Free Schools and Communities Act (DFSCA) enforces all US colleges to put forward preventive info on alcohol and drugs if they want to receive federal funding.
While cannabis is a no-no in US colleges, does that mean CBD is also off-limits in college? After all, the 2018 US Farm Bill legalized hemp-derived items like CBD. Also, since CBD is non-psychoactive, it doesn’t carry the “high-inducing” reputation of delta-9 THC.
Although CBD oil is better tolerated in the US than straight cannabis, freshmen can’t assume it’s OK to pack hemp flowers before their first semester.
So, Is CBD Illegal On College Campuses?
Per the 2018 US Farm Bill, hemp CBD shouldn’t be illegal on US college campuses. The federal government allows people to use, buy, and sell hemp-derived items with ≤ 0.3 percent delta-9 THC. So, every public university should abide by this new standard.
However, there’s some confusion over whether CBD oil should be included as a part of the DFSCA’s policy. Even though hemp CBD oil doesn’t come from THC-heavy cannabis plants, the DFSCA has yet to formally distinguish hemp from marijuana.
Also, each US state can formulate unique rules for selling CBD oil. Even though most states accept CBD oil, some territories only allow CBD oils with zero THC. Some regions may require residents to have a formal doctor’s note to use a full-spectrum CBD oil.
Not only can states dictate different CBD laws, but each college campus can develop its own drug policy. Since private colleges don’t answer to the federal government, it’s more difficult to argue they must abide by the 2018 US Farm Bill. However, even public universities don’t necessarily need to embrace CBD oil if they don’t want to.
Therefore, even though CBD hemp is OK at the federal level, there’s a chance a student’s college may not embrace CBD. Parents and students should carefully review the latest drug policies on their campus before arriving for orientation. If people can’t find clear info on a separation between hemp and marijuana, contact the school directly for specific information.
Never Bring Untested CBD To College!
Even if your college allows students to use CBD oil, it’s unlikely they will be OK with any hemp-derived product. At the very least, you must ensure the CBD oil you use has ≤ 0.3 percent delta-9 THC. Sometimes, you may need to prioritize broad-spectrum CBD oils or CBD isolate powders. These latter products should have zero delta-9 THC.
